Critical Medical Disclaimer — Read Before Using
MEDTRACK AI IS NOT A MEDICAL DEVICE, A HEALTHCARE PROVIDER, A CLINICAL LABORATORY, A DIAGNOSTIC TOOL, OR A SUBSTITUTE FOR PROFESSIONAL MEDICAL JUDGMENT.
The Service provides automated data extraction, formatting, and organizational tools for personal record-keeping convenience only. All content, charts, trend lines, extracted metric values, AI interpretations, and generated text provided by MedTrack AI:
- DO NOT constitute medical advice, clinical diagnosis, prognosis, treatment recommendations, prescription guidance, or second opinions.
- MUST NEVER be used as a replacement for consultation, examination, diagnosis, or treatment by a qualified, licensed physician, specialist, or other healthcare professional.
- CANNOT be relied upon to assess, diagnose, or respond to medical emergencies. If you believe you are experiencing a medical emergency, immediately call your local emergency services (e.g., 112 in India, 911 in the US, 999 in the UK, 108 ambulance services) or proceed to the nearest hospital emergency department.
- MAY CONTAIN ERRORS: AI-extracted values may be inaccurate, incomplete, misread, inverted, or hallucinated. Always verify all extracted data against your original physical laboratory reports.
By using this Service, you acknowledge that you understand and accept that MedTrack AI bears absolutely no responsibility for any health decisions, actions, or inactions you take based on information displayed by the Service. Never disregard, avoid, or delay obtaining professional medical advice because of information presented on MedTrack AI.
1. Acceptance of Terms
By accessing, registering for, or using MedTrack AI (the “Service”, available at https://medtrack-ai.live), you (“User”, “you”, or “your”) acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to any part of these Terms, you must immediately stop using the Service.
2. AI Processing & Accuracy Disclaimer
MedTrack AI uses Large Language Models and Vision-Language Models (including Google Gemini) to parse uploaded medical documents. You explicitly acknowledge and agree that:
- Inherent Limitations: AI systems may occasionally misread numbers, misinterpret medical abbreviations, omit biomarkers, confuse reference ranges, produce fabricated values (“hallucinations”), or generate otherwise inaccurate outputs.
- User Responsibility to Verify: You bear sole and exclusive responsibility for verifying every number, metric, reference interval, test name, and date against your physical original laboratory reports before taking any action.
- No Warranty of Accuracy or Completeness: MedTrack AI makes no representation, guarantee, or warranty that any extraction is accurate, complete, current, or error-free.
- Not Clinical Grade: The extraction technology has not been validated, cleared, or approved by any medical regulatory authority (including but not limited to the US FDA, CDSCO India, EMA, or TGA Australia).
3. Eligibility & Acceptable Use
To use MedTrack AI, you must authenticate via Google OAuth. You represent and warrant that:
- You are at least 18 years of age, or are accessing the Service under the supervision of a parent or legal guardian who accepts these Terms on your behalf.
- You are legally capable of entering into binding contracts in your jurisdiction.
- You will only upload medical documents that belong to you, or for which you possess explicit, documented legal authorization (such as power of attorney, legal guardianship, or written patient consent) to upload and manage.
- You will not use the Service for any unlawful, fraudulent, or unauthorized purpose, including but not limited to: reverse engineering, web scraping, denial-of-service attacks, uploading malicious files, attempting to bypass rate limits or authentication, impersonating other users, or accessing data belonging to other accounts.
- You will not use the Service to process documents belonging to patients (if you are a healthcare professional) without obtaining proper informed consent in compliance with applicable healthcare privacy regulations.
4. Uploaded Content & Your Responsibility
You are solely responsible for the content and legality of all files and documents you upload to MedTrack AI. By uploading a document, you confirm that you have the legal right to do so and that the upload does not violate any applicable law, regulation, or third-party rights (including privacy, intellectual property, and data protection rights of the individuals whose health data may be contained in the document).
5. Free Tier, Subscriptions & Billing
Free Tier: Every new account receives a complimentary trial to upload and analyze up to two (2) medical documents at no cost.
Paid Subscriptions: To analyze additional documents beyond the free tier, you may purchase a recurring monthly subscription. Pricing varies by country and is displayed before checkout. Subscriptions are billed in advance on a recurring monthly basis via our authorized payment processor, Razorpay.
Cancellation: You may cancel your subscription at any time via your account settings or by contacting support. Cancellation takes effect at the end of the current paid billing period. You will retain full access to the Service until that date.
Refund Policy: Because AI processing costs and cloud server resources are consumed immediately and irreversibly upon document analysis, subscription fees are generally non-refundable once paid. Exceptions may be made at our sole discretion or where required by mandatory applicable consumer protection laws in your jurisdiction.
Price Changes: We reserve the right to modify subscription pricing with at least 30 days' advance notice. Price changes will apply to the next billing cycle following the notice period.
6. Intellectual Property & Ownership
Your Data: You retain full ownership, title, and all rights to every document, image, and file you upload to MedTrack AI. You grant MedTrack AI a limited, non-exclusive, revocable, non-transferable license solely to host, process, and display your data back to you for the purpose of providing the Service. This license terminates immediately when you delete your data or your account.
Our Service: The MedTrack AI software, user interface design, branding, algorithms, logos, icons, CSS styling, and source code are the exclusive intellectual property of MedTrack AI and are protected by applicable copyright, trademark, and intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED STRICTLY ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEDTRACK AI EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPLETENESS, TITLE, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT AI EXTRACTION RESULTS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY MEDICAL OR CLINICAL PURPOSE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW:
IN NO EVENT SHALL MEDTRACK AI, ITS FOUNDER(S), OPERATORS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:
- PERSONAL INJURY, BODILY HARM, WRONGFUL DEATH, HEALTH DETERIORATION, MISDIAGNOSIS, DELAYED DIAGNOSIS, OR ANY ADVERSE HEALTH OUTCOME RESULTING DIRECTLY OR INDIRECTLY FROM RELIANCE ON THE SERVICE, AI EXTRACTION OUTPUTS, OR TREND VISUALIZATIONS;
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR ANTICIPATED SAVINGS;
- ANY ERRORS, OMISSIONS, INACCURACIES, OR DEFECTS IN AI EXTRACTION, PROCESSING, TRANSMISSION, OR DISPLAY OF MEDICAL DOCUMENTS OR DATA;
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS;
- ANY THIRD-PARTY CONDUCT OR CONTENT ON OR THROUGH THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL BE STRICTLY LIMITED TO THE LESSER OF: (A) THE TOTAL AMOUNT YOU ACTUALLY PAID TO MEDTRACK AI IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED INDIAN RUPEES (₹100 / ~$1.20 USD).
9. Indemnification
You agree to defend, indemnify, and hold harmless MedTrack AI, its founder(s), operators, officers, directors, employees, agents, and contractors from and against any and all third-party claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable legal fees and court costs) arising out of or relating to: (a) your violation of these Terms; (b) your uploaded documents or data; (c) your misuse of the Service; (d) your violation of any applicable law or regulation; or (e) your infringement of any third party's rights, including privacy and intellectual property rights.
10. Third-Party Links & Services
The Service may contain links to third-party websites or services (such as Razorpay for payments, Google for authentication). These links are provided for convenience only. MedTrack AI does not endorse, control, or assume responsibility for the content, privacy policies, terms of service, or practices of any third-party websites. Your interactions with such third parties are governed solely by their own terms and policies.
11. Service Availability & Force Majeure
We strive to keep MedTrack AI available 24/7. However, the Service may be temporarily unavailable due to scheduled maintenance, system upgrades, cloud provider outages, or circumstances beyond our reasonable control (including natural disasters, pandemics, wars, government actions, cyberattacks, internet failures, or power outages). MedTrack AI shall not be liable for any loss or damage arising from such unavailability.
12. Termination
We reserve the right to suspend, restrict, or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in abusive behavior, or pose a security risk. You may also terminate your account at any time by requesting account deletion. Upon termination, your right to access the Service ceases immediately. Sections 7 (Warranty Disclaimer), 8 (Limitation of Liability), 9 (Indemnification), and 14 (Governing Law) shall survive any termination.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. Continued use of the Service after any modifications constitutes your binding acceptance of the revised Terms. If you do not agree with the modified Terms, you must stop using the Service.
14. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Karnataka, India. Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.
15. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MedTrack AI regarding the use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
